Two kinds of LPA, for two kinds of decision

Each is its own document, registered on its own. Most people make both, with the same people or different ones.

Property and financial affairs

Money, bills and your home

Your attorneys can

  • Pay bills and run your bank accounts
  • Collect your pension and benefits
  • Sell your home if you need to move
  • Deal with tax and investments

Usable once it's registered, with your permission, so it can help even while you're well.

Health and welfare

Your care and treatment

Your attorneys can

  • Decide where you live and who cares for you
  • Agree your daily routine, such as diet and dress
  • Consent to or refuse medical care
  • Decide about life-sustaining treatment, only if you allow it

Only used if you can't make the decision yourself at the time.

Why make one now, not later

  1. 01

It can only be made while you can decide for yourself. An illness or accident can change that without warning, at any age.

  2. 02

Your family can't simply step in.Not even a husband, wife or partner. Without an LPA they may have to apply to the Court of Protection, which takes longer and costs more.

  3. 03

Registering takes time. The Office of the Public Guardian takes about 8 to 10 weeks, so start now and it's ready before it's needed.

Who's who in an LPA

A few people play a part. We ask about each of them in turn, and check they can.

You, the donor
The person making the LPA. You need to be 18 or over and able to make your own decisions when you sign.
Your attorneys
One or more people you trust to decide for you, aged 18 or over. Often a partner, grown-up children or a close friend.
Replacement attorneys
Optional: people who step in if one of your attorneys can no longer act.
A certificate provider
Someone who has known you well for two years, or a professional such as your GP. They confirm you understand and aren't being pressured. Not family, and not an attorney.
Witnesses
Adults who watch you and your attorneys sign. An attorney can't witness your signature.
People to tell
Optional: people told before it's registered, so they can raise any concerns.

What is a lasting power of attorney?

A legal document that lets you choose people (your attorneys) to make decisions for you if you can't. There are two kinds: one for money and property, and one for health and care. Each must be registered with the Office of the Public Guardian before it can be used.

Do I need both kinds?

Most people make both, because they cover different decisions. A property and financial affairs LPA can't be used for decisions about your care, and a health and welfare LPA can't be used for your money.

Can I sign it online?

Not yet. The law still needs everyone to sign the printed forms in ink, in a set order. We fill the forms in for you and give you a signing pack that shows exactly who signs where, so nothing is missed.

Who can be my certificate provider?

Someone aged 18 or over who has known you well for at least two years, such as a friend or neighbour, or a professional such as your GP or a solicitor. It can't be one of your attorneys or a member of your or their family. We check this as you go.

How long does registering take, and what does it cost?

About 8 to 10 weeks if there are no mistakes. The Office of the Public Guardian charges £92 per LPA, paid to them directly. It's half that on a low income, and nothing on certain benefits.

Can I change my mind later?

Yes. While you can still make your own decisions, you can cancel an LPA or make a new one. Your attorneys can only act within the powers you've given them, and must act in your best interests.

Decide now, while it's your choice.

About twenty minutes to answer, and your forms are ready to print. Or talk it through first: lines are open Monday to Saturday, 8am to 8pm.
