Terms and conditions

Last updated 3 November 2026

These terms apply when you use our website or buy any of our services. Please read them: they explain what we do and don't do, what we need from you, and your rights, including your right to cancel. Our privacy policy explains how we use your information.

1. About us and these terms

Larktree is a trading name of Larktree Ltd, a company registered in England and Wales (number [COMPANY NUMBER]), registered office [REGISTERED ADDRESS]. You can contact us on 0800 123 4567, by email at [CONTACT EMAIL], or by post at [POSTAL ADDRESS].

When you buy from us, we make a contract with you on these terms, together with what's described at checkout for the package you chose. If something at checkout differs from these terms, what was at checkout applies.

These terms are for consumers: people buying for themselves or their family, not for business. Nothing in them affects your statutory rights.

2. What we do, and what we don't

We help you prepare a will, mirror wills, or lasting powers of attorney (LPAs) for England and Wales, using our online forms, our specialists, or both, depending on the package. Larktree Ltd is not a firm of solicitors and isn't regulated by the Solicitors Regulation Authority. [REGULATORY STATEMENT]

Information, not advice. Our website, forms and guides give general information to help you make your own choices. They aren't legal, tax or financial advice for your circumstances. Where your package includes a specialist's review or help, the specialist checks your document and answers your questions about it; if your situation needs advice we can't give (for example on complex tax planning, foreign property or a business), we'll tell you and suggest you see a solicitor or other adviser.

Our online service isn't for everyone. Our questions at the start check that it suits you: for example that you live in England or Wales and your assets are in the UK. If your answers suggest it doesn't, or you'd rather talk it through, we'll offer a call with a specialist instead. Please answer them accurately: if your circumstances differ, your document may not do what you intend.

Probate, trusts, tax and insurance are handled by phone with a specialist, not through these online services. Anything you agree for them will be set out separately before you commit.

3. What we need from you

  • You must be 18 or over, and making the document for yourself, or helping someone who will read, understand and sign it themselves.
  • The information you give us must be true, complete and up to date: your documents are only as good as what goes into them. Check your documents carefully before you sign.
  • You must have the mental capacity to make the document, and make it freely, without pressure from anyone.
  • Only give us other people's details if you're entitled to, and tell them (see our privacy policy).
  • Keep your account details secure and don't share your password.

4. Our will and LPA packages

Each package's features and price are shown before you pay. In summary:

  • Essentials: you complete your will or LPAs online and download them, ready to print and sign. No one checks them for you.
  • Reviewed: as Essentials, plus a specialist reviews your answers before your document is final, may ask you to change or clarify things, and answers your questions. A Reviewed will includes your first year of storage of the signed original.
  • Guided: a specialist writes your will with you by phone. The price is agreed with you, for your situation, before we start, and Guided includes what Reviewed does.

A Reviewed or Guided will includes up to two changes within 12 months of it being finalised, as described in your account. After that, or for other packages, changes are a new will at the price then shown.

A specialist review is a check of the document you've prepared, against the answers you gave. It isn't a guarantee that your document will achieve every aim, or that nobody will ever challenge it.

5. Signing your will and LPAs

Your documents are only valid once they're signed correctly. We give you signing instructions with each one: please follow them exactly.

  • A will must be signed by you in the presence of two independent adult witnesses, both present at the same time, who then sign in your presence. A witness, or the husband, wife or civil partner of a witness, shouldn't benefit from the will, or they may lose their gift.
  • An LPA must be signed in the order the form sets out, by you, your certificate provider, then your attorneys and replacements, with witnesses where shown, and then registered with the Office of the Public Guardian (OPG) before it can be used. You (or your attorneys) send it to the OPG and pay the OPG's registration fee to them directly; it isn't included in our price.

We don't sign or witness documents, and we can't tell whether a document was signed properly unless you send it to us to store. We're not responsible if a document is invalid because it wasn't signed as instructed, or if the OPG refuses to register an LPA because of information you gave or the way it was signed. If the OPG rejects an LPA because of a mistake we made, we'll correct it free of charge.

Your circumstances will change. Review your will every few years, and after events such as marriage or civil partnership (which can cancel an earlier will), divorce, a new child, or moving house. It's up to you to keep it up to date.

6. Storing your will

If you choose storage, you post us your signed original will and we keep it securely, record where it is, and release it after your death to your executors (or as the law requires). We'll confirm when it arrives. Please keep a copy yourself, and tell your executors that we hold it.

Storage is paid yearly. The first year is included with a Reviewed will; after that, it renews only if you've chosen to renew. If you're paying for storage on its own, it renews automatically each year until you stop it (see renewals below).

If storage ends and isn't renewed, we'll tell you, and if it's still unpaid 60 days later we'll post your original will back to the address on your account. Please keep your address up to date. We'll also post it back whenever you ask.

We take care of the documents we store, but we're not responsible for loss caused by events outside our reasonable control. If your original will is lost while in our care through our fault, we'll help you make a new one free of charge.

7. Legacy pages

Legacy lets you keep letters, photos, voice recordings and documents on a private page, and choose who receives them: straight away, on a date, or after your death.

  • Your page is protected by a password you choose. Anyone with the password or a link you've sent can see what's shared with them, so share it carefully.
  • You're responsible for what you upload. It must be yours to share, and mustn't be unlawful, offensive, or infringe anyone's rights. We may remove content that breaks these rules. You keep ownership of it, and give us permission to store it and show it to the people you choose.
  • After your death: items you chose to share after your death are released only after we've confirmed it from official records and checked it ourselves. Before releasing anything we email and text you, and you have 7 days to stop it by signing in. Once released, your page stays available for 5 years.
  • Legacy is a yearly subscription that renews automatically until you cancel. If it lapses, your page is kept for a year, and we'll warn you at least 30 days before we delete it. You can download your files, or delete your page, at any time.
  • Legacy isn't a will. Nothing on your Legacy page changes what your will says: put anything you want to be legally binding in your will.

8. Professional executors

If you name Larktree Ltd as a professional executor in your will, we'll only act after your death if we're able to and agree to at that time, and our fees for acting are charged to your estate, not to you now. We'll explain our charging basis before you choose this, and your will includes a clause allowing us to charge for our work.

9. Prices and paying

Our prices are in pounds sterling and include VAT. We charge the price shown when you pay; if we've made an obvious mistake in a price, we'll contact you before going ahead. We take payment by card, and by Apple Pay or Google Pay where available, through Stripe.

If you choose to save your card, or buy something that renews, we keep a reference to your card with Stripe so it can be charged for renewals you've agreed to. You can change or remove it from your account.

10. Subscriptions and renewals

Legacy, and storage bought on its own, are yearly subscriptions. They renew automatically on the same date each year, at the price then in force, until you stop them. We'll remind you at least 30 days before each renewal, and tell you in advance if the price is changing.

You can stop renewing at any time from your account, or by contacting us. The service then carries on until the end of the year you've paid for. If you cancel within 14 days of a renewal payment, we'll refund it in full.

11. Your right to cancel

You have the right to cancel within 14 days of buying from us, without giving a reason, under the Consumer Contracts Regulations 2013. To cancel, tell us clearly: call us, email us, or use the form below.

When you pay, you ask us to start straight away: your document becomes available to finish, review and download, and a specialist may start work. So:

  • if you cancel before your document is finalised, we'll refund you in full, less a fair amount for any specialist work already done;
  • once your finished will or LPA is available to download, it's digital content you've received, and you can no longer cancel that purchase;
  • subscriptions can be cancelled within 14 days of starting for a full refund.

We'll refund you within 14 days of you telling us, to the card you paid with.

Cancellation form

If you'd like to cancel in writing, copy and complete this and send it to [CONTACT EMAIL] or [POSTAL ADDRESS]: "To Larktree Ltd: I hereby give notice that I cancel my contract for the following service: [service and reference]. Ordered on: [date]. Name: [your name]. Address: [your address]. Signature (if on paper). Date."

12. If something goes wrong

We'll provide our services with reasonable care and skill. If we don't, tell us and we'll put it right, for example by correcting your document free of charge, or refunding part of what you paid if we can't. See making a complaint for how we handle complaints.

We're responsible for loss you suffer that's a foreseeable result of our breaking these terms or failing to use reasonable care. We're not responsible for loss that wasn't foreseeable, for loss caused by information you gave us being wrong or incomplete, or by a document not being signed, witnessed, registered or kept up to date as we instructed.

Unless the law says otherwise, our total liability to you for any one purchase is limited to [LIABILITY CAP], or if greater, the price you paid. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit, including your rights under the Consumer Rights Act 2015.

13. Using our website

You may use our website for your own personal use. Please don't misuse it: don't try to get into accounts or parts of the site that aren't yours, interfere with how it works, or use automated tools to access it. We may suspend an account that's being misused.

We try to keep the website available and accurate, but can't promise it will always be. Our guides are general information, correct when written; the law changes, so check before relying on them. The content of our website belongs to us or our licensors. The official LPA forms we fill in are Crown copyright, used under the Open Government Licence.

If you started a will or LPA without an account and haven't paid for it or changed it in 90 days, we delete it automatically.

14. Other important terms

  • We may change these terms. The terms in force when you bought apply to that purchase; for subscriptions, we'll tell you of any change that affects you before your next renewal, and you can cancel if you don't agree.
  • We may transfer our agreement with you to another business, for example if our business is sold, so long as your rights aren't reduced. We'll tell you if we do.
  • If a court decides part of these terms is invalid, the rest still applies.
  • If we don't enforce a right straight away, we can still enforce it later.
  • Nobody else has rights under these terms, except your personal representatives after your death.
  • These terms are governed by the law of England and Wales, and you can bring proceedings in the courts of England and Wales (or, if you live in Scotland or Northern Ireland, there).
